25th August 2017 will go down in the history of Kenyans as the day the Supreme Court nullified the presidential election thus going against the will of eight million people who had exercised their right of choosing their preferred president. It was an unexpected verdict that as the president
said “Needs to be revisited”if only to clear the air. It came as a shock to many, the lawyers of the 2nd respondent and the citizens in general.
It was expected that just as the dissenting judges namely Justice Njoki Ndung’u and Justice Ojwang gave their detailed reasons for going against the majority ruling, the same would happen to the four who ruled in favor of the petitioner.
That aside, the ball was returned to IEBC court.The constitution clearly states that upon nullification by the supreme court, a fresh election will be conducted within 3 months and thus, IEBC as an Independent body exercised its mandate and declared 17th October 2017 as the day for another battle of the titans. President Uhuru Kenyatta and Raila Odinga meet again in the ballot.
The Nasa Coalition however, have come out strongly rejecting the dates citing non consultation. They however have not indicated the move they will be taking. As we wait for the move lets still focus on 17/10/2017.
    President Uhuru Kenyatta convened a meeting with all Jubilee legislatures on 2nd September 2017. During the meeting he called upon the Jubilee law makers to conduct the campaigns in the grassroots level in readiness for the big day and ensure 100% voter turnout.
It will be a battle to watch as each side will want to woo the famous swing vote to add into their basket.
As Nasa will be trying to bridge the 1.4 million gap, Jubilee will be working harder to hit a remarkable 10 million.Its upon the leaders to conduct intense civic education to avoid the high number of spoilt votes. They will also need to mobilize as many voters as they can and avoid the chronic problem of voter apathy.
Jubilee has an added advantage of having the government machinery at hand so an intense campaign is expected.
The tyranny of numbers is an added advantage as they will be able to cover enough ground and pull more votes.
Supreme Court has received backlash from the Jubilee corner for giving a half-baked judgment. A summary of the verdict indicates that the election was nullified on technicality issues. The transmission mode was also faulted leaving the questions…Was it only the presidential results that were transmitted? The judges also faulted IEBC for failing to follow the constitution?
Did these really warrant the nullification? Only time will tell.
